DINGO MFG – RELEASE OF LIABILITY, NO REFUND POLICY, AND ACKNOWLEDGEMENT OF RISK
This Agreement is entered into by and between Dingo MFG (“Builder”) and the undersigned customer (“Customer”).
By purchasing products, parts, or services from Dingo MFG, the Customer acknowledges and agrees to the following:
1. ASSUMPTION OF RISK
Customers understand that all parts, components, and modifications provided by Dingo MFG are intended for use on custom motorcycles and may affect the safety, performance, and reliability of the vehicle.
Customer acknowledges that:
- Custom motorcycle parts and modifications carry inherent risks.
- Improper installation, misuse, or unforeseen mechanical issues may result in injury, death, or property damage.
- Customers assume all responsibility for proper installation, use, and maintenance.
2. RELEASE OF LIABILITY
Customer agrees to release, waive, and discharge Dingo MFG, its owner(s), and affiliates from any and all liability, claims, demands, damages, or causes of action arising from:
- Use or misuse of any product
- Installation (whether performed by Customer or third party)
- Mechanical failure or performance issues
- Injury, death, or property damage
This release applies to the fullest extent permitted by law.
3. NO WARRANTY
All products and services are provided “as-is” with no warranties, express or implied, including but not limited to:
- Fitness for a particular purpose
- Merchantability
- Longevity or durability
Customers understand that Dingo MFG produces small-batch, custom, or handmade parts which may have minor imperfections.
4. NO REFUND / NO RETURN POLICY
All sales are final.
Dingo MFG does not offer:
- Refunds
- Returns
- Exchanges
Exceptions may be made solely at the discretion of Dingo MFG in cases of proven manufacturing defects or issues with fabrication discrepancies
5. NON-PROFESSIONAL ACKNOWLEDGEMENT
Customer understands and acknowledges that:
- Dingo MFG operates as an independent garage-based builder and manufacturer.
- Builder is not a certified engineer, OEM manufacturer, or licensed professional in any regulated capacity.
- Products are designed and produced based on experience, not formal certification.
Customers accept all risks associated with purchasing and using such products.
6. INSTALLATION RESPONSIBILITY
Customer is solely responsible for:
- Ensuring proper fitment
- Using qualified mechanics if necessary
- Verifying safety before operation
Dingo MFG is not responsible for installation errors.
7. INDEMNIFICATION
Customer agrees to indemnify and hold harmless Dingo MFG from any claims, damages, or legal actions arising from use of purchased products.
8. GOVERNING LAW
This Agreement shall be governed by the laws of the State of COLORADO.
9. AGREEMENT ACKNOWLEDGEMENT
By purchasing from Dingo MFG, the Customer acknowledges that they have read, understood, and agreed to this document in full.
